Scott Gratton received his JD from The University of Montana School of Law and has been licensed to practice law since 1987. In 1988, Mr. Gratton began practicing at the Brown Law Firm, P.C., a private Personal Injury and General practice in Missoula, Montana. He became a partner in 1994. Mr. Gratton’s main areas of practice include: defense of complex civil litigation, defense of catastrophic personal injury and wrongful death claims, insurance law including coverage and defense of bad faith claims, product liability defense, defense of medical and dental malpractice claims, labor and employee relations, minerals, oils and gas, banking, workers compensation, bankruptcy (debtor claims), real estate, construction defect and appellate law. Founding partner, Earl I. Higgs, Jr., is a Miami, Florida native and graduate of the University of Florida, where he walked-on as a running back for Florida Gator Football Team. As a member of the Gator Football team he was an SEC Academic All-American during his time with the team. While in law school at the University of Florida Levin College of Law, Earl participated in a study abroad program at the University of Montpellier, in Montpellier, France and was a member of the Journal of Law and Public Policy. After graduating, Earl gained invaluable legal experience practicing workers’ compensation and later worked for one of the largest plaintiff’s firms in the country. For close to 20 years, Earl has devoted his practice to insurance claims and appellate cases. He has represented thousands of businesses and homeowners against insurance companies and has handled a multitude of cases involving property damage, business interruption, hurricane damage, and sinkhole claims. Following Hurricanes Charlie, Frances and Jean, Earl represented hundreds of businesses and homeowners whose claims were denied, delayed or unfairly compensated. He successfully obtained close to a million dollars on behalf of his clients for damages from those hurricanes and continues fighting for clients affected by more recent storms.

Tom began trying insurance defense cases almost immediately upon graduation from law school. He quickly developed a reputation as a trial lawyer, trying all types of cases ranging from automobile accidents, slip-and-falls, arsons, construction claims, and products liability. Tom’s reputation for relating to jurors encouraged other attorneys to refer clients with personal injury claims to him. Tom has successfully represented clients on both sides of the courtroom and sincerely believes that trying cases from both perspectives allows him to more thoroughly and objectively guide his clients through litigation. Tom’s experience representing both plaintiffs and defendants, combined with his reputation for reasonableness, has lead to a successful practice as a mediator. Tom received an “AV” rating from Martindale-Hubbell at a relatively young age and continues to hold this highest designation. He has also been listed in the Kentucky Super Lawyers listing from 2008 – 2018, The Best Lawyers in America and Top 100 Trial Lawyers. He has served as a Special Justice to the Kentucky Supreme Court and was fortunate to write the opinion. Mr. Kritzer holds a Bachelor of Science in Accounting and Finance from SUNY Buffalo (1989), and his Juris Doctor from New York Law School (1992). He was admitted to practice in New York State in 1992, and he is also admitted to practice in the United States District Court for both the Eastern and Southern Districts of New York. He is also a member of numerous bar and trial lawyer associations including the American Bar Association, the New York State Bar Association, and the Suffolk County Bar Association.
