Barry Goheen Civil Litigation

Barry Goheen received both his B.A. (1989) and J.D. (1994) from Vanderbilt University. Mr. Goheen is currently a partner at FisherBroyles, LLP and has practiced law for over 25 years. His main areas of practice include: Commercial Litigation and Class Action Defense, Cyber-Risk; Privacy & Data Security, Civil Pretrial & Trial Services, TCPA Practice Group, Products Liability Litigation and Counseling. He is admitted to practice in the state and federal courts of Georgia and Tennessee as well as all federal Courts of Appeals except the D.C. Circuit. He has argued appeals before the United States Courts of Appeals for the First, Fourth, Sixth, Ninth, Tenth, and Eleventh Circuits. Mr. Goheen has served as lead or co-counsel in over 50 class actions in state and federal courts representing such clients as SunTrust Banks, Pet Supermarket, Mid-America Apartment Communities, Shell, Countrywide, Equifax, Bank of America, SCANA, Fifth Third Bank, Home Depot, Aaron’s, GreenSky, Chico’s, and Wal-Mart, arising under federal statutes such as the Fair Credit Reporting Act, the Telephone Consumer Protection Act, and the Fair and Accurate Credit Transactions Act, as well as numerous state statutes. He has tried cases to verdict in matters involving such varied subjects as tobacco, civil RICO, and the FCRA, among numerous other trials. He also counsels and represents clients in cyber and privacy-based legal matters. Mr. Goheen has written articles for such legal publications as Consumer Financial Services Law Report, Journal of Taxation and Regulation of Financial Institutions, Practical Law, PREA Quarterly, Corporate Disputes, Law360, and Corporate Counsel. He also has been quoted in the Bloomberg/BNA Class Action Litigation Report, www.bankinfosecurity.com, and www.businessinsurance.com. Further, Mr. Goheen is an adjunct professor at Emory School of Law and teaches Advanced Pretrial Litigation and Class Actions. Prior to joining FisherBroyles, Mr. Goheen was a partner in the Atlanta office of King & Spalding.
