Tina Rose Di Benedetto Workers Compensation Law

Ms. Di Benedetto was admitted to the Illinois State Bar Association in 1998 and worked as in-house counsel for Traveler’s Insurance specializing in Workers’ Compensation defense and Third-Party Lien Recovery. In 1999, she ventured into private law practice continuing her ambition of defending employers and businesses of all kinds and ventured into Labor and Employment Law, as well. Ms. Di Benedetto is a skilled litigator who has the unique ability to visualize a case to its end. In doing so, she strategically approaches each case, maintains focus, picks her battles carefully and gathers the evidence and information necessary to achieve the best outcome for her clients. Over the past 19 years, she has tried and argued numerous cases at the Illinois Workers’ Compensation Commission and Circuit Court. She has received zeros on cases where the demand was over $500,000. She has also successfully argued before the Illinois Appellate Court reversing the lower court’s decision and obtained a published opinion regarding idiopathic falls. (Builders Square v. Industrial Com’n 339 Ill.App.3d 1006, 791 N.E.2d 1308, 274 Ill.Dec.897) Furthermore, she understands whether a case should be tried or settled. She has achieved hundreds of complex settlements for her clients. These settlements include cases with not only large exposure for permanency, but where the medical bills have been run up extremely high by overzealous medical providers and facilities. Ms. Di Benedetto has assisted in establishing Preferred Provider Programs for her clients resulting in better managed claims and lower costs. She has also consulted with clients at both a local and national level on improvements in their workers’ compensation claims and return to work programs, thereby lessening the exposure on potential wage differential and/or odd-lot permanent total cases. She is working to make Transitional Employment an accepted practice in Illinois. She also presents at seminars on various employment related topics.
