Area of Practice: White Colllar & Complex Litigation Jenny Durkan is a partner in the firm’s Business & Commercial Disputes Practice Group and leads the U.S. White Collar Team. A nationally recognized lawyer with over 35 years of experience, Jenny is a Fellow of the American College of Trial Lawyers. She has a proven track record of successfully addressing a client’s most complex domestic and international matters. Known for her deep understanding of cybercrime, national security, and investigations, Jenny’s practice spans white collar defense, crisis management, and high-stakes litigation, representing both public and private clients. She served as the mayor of Seattle from 2017 through 2021, leading the city through the COVID-19 pandemic. Through her leadership, Seattle had the lowest incidence of disease, hospitalization, and death of any U.S. city, despite being the first area of diagnosed cases and deaths. Her work during the pandemic earned her recognition from Fortune Magazine, naming her one of the “World’s 25 Greatest Leaders: Heroes of the Pandemic” in 2020. In June 2024, she was also recognized as a “Lamplighter” for her pandemic response by the American Democracy and Health Security Initiative, a collaboration that includes Brown University School of Public Health Pandemic Center and the Center for Strategic and International Studies. Alongside her efforts in public health, Jenny championed educational opportunities through the Seattle Promise, a program providing two years of free college to public high school graduates. Her leadership continued to expand outside of Seattle, as she played a significant role on the international Steering Committee of C40 Cities, a global coalition of cities committed to addressing climate change. She also served on the C40 Mayors’ COVID-19 Recovery Task Force, collaborating with mayors from diverse regions to shape recovery efforts with a focus on climate, health, and economic resilience. As U.S. attorney for the Western District of Washington from 2009 to 2014, Jenny served as the chief federal law enforcement officer for the region, overseeing all federal prosecutions and representing the U.S. in civil matters. During her tenure, she chaired the Key Department of Justice (DOJ) Subcommittee on Cybercrime, in which she played a key role in revamping national strategies to detect and disrupt criminal and national security cyber threats. Her office investigated and prosecuted some of the first international cybercrime cases. Jenny also served on the U.S. Attorney General’s Advisory Committee and was also a member of the DOJ’s National Security Subcommittee. She held the highest national security clearances and was regularly briefed on classified matters related to cyber and national security threats. She testified before Congress on cybercrime issues for DOJ and worked closely with the range of federal law enforcement agencies and the European Cybercrime Center. After leaving her U.S. attorney position, she served on the U.S. Secret Service Cyber Investigations Advisory Board. She also was a partner in a major international law firm, focusing on litigation, investigations, and trans-border issues. She represented FIFA in a broad internal investigation and related civil and criminal actions. She has consistently worked at the intersection of the law and technology, and currently chairs the Washington State Bar Association Task Force on Emerging Technologies such as artificial intelligence and the practice of law.

Tiffany R. Durst was born in Waynesburg, Pennsylvania in February 1971. She attended Clay-Battelle High School in Blacksville, West Virginia and then West Virginia University in Morgantown, West Virginia. Tiffany was on the Dean’s List and/or the President’s List for academic honors the entirety of her undergraduate education. In 1993, Tiffany completed her undergraduate education, graduating Magna Cum Laude with a Bachelor of Arts in Sociology and Anthropology. In the fall of 1994, Tiffany began her legal education at the West Virginia University College of Law in Morgantown, West Virginia. Tiffany earned her J.D. in 1997 from the College of Law. Following admission to the West Virginia State Bar, Tiffany began work with McNeer, Highland, McMunn & Varner, L.C., in Clarksburg, West Virginia as an associate. In 2004, Tiffany became a director with McNeer, Highland, McMunn & Varner, L.C. Tiffany’s practice included defense litigation, representing insurers and corporations in a wide variety of litigation including insurance defense, insurance coverage, insurance extracontractual liability (bad faith), medical malpractice defense, nursing home negligence defense, legal malpractice defense, adoption, and personal injury defense. In addition, Tiffany had an active appellate practice before the West Virginia Supreme Court of Appeals, presenting oral argument before the Court in both appeals and extraordinary petitions on several occasions. In that regard, Tiffany was chief appellate counsel in Strahin v. Sullivan, 230 W.Va. 329, 647 S.E.2d 765, (2007) and Jackson v. State Farm Mutual Automobile Insurance Company, 215 W. Va. 364, 600 S.E.2d 346 (2004), two seminal cases addressing insurance bad faith and excess verdicts in the State of West Virginia. In March of 2008, Tiffany continued her legal practice when she joined the law firm of Pullin, Fowler, Flanagan, Brown & Poe, PLLC, as a member, in the firm’s Morgantown office. She has continued her appellate practice and has also developed an active trial practice with over forty trials where she represents clients in a number of different areas of the law, including bad faith, deliberate intent, employment law and medical malpractice. Tiffany is admitted to practice before the West Virginia Supreme Court of Appeals, the United States District Court, in both the Northern and Southern Districts of West Virginia, the United States Court of Appeals for the Fourth Circuit, and the United States Supreme Court. Tiffany is also actively involved in the Monongalia County Bar Association currently serving as Secretary. She is also a member of the American Board of Trial Advocates where she serves as Vice President of the West Virginia Chapter. In addition, Tiffany serves as a Board Member for Panhandle Farmers Mutual Insurance Company. Tiffany currently resides in Blacksville with her husband, James, and their two labs, Loomis and Darby. She enjoys all things WVU Sports and vacationing at the beach. Tiffany is also a member of Mason-Dixon Rotary where she enjoys service-oriented activities in her local community.

Mr. Dutton obtained his doctorate of law in 1984 from Ohio Northern University, Pettit College of Law, which is one of the oldest law schools in the United States. During law school Mr. Dutton was honored on the Dean’s List during his second and third years of legal study. While in law school Mr. Dutton also received a diploma from the Institute of Comparative and International Law located at Oxford University in Oxford, England. During Mr. Dutton’s course of study at Ohio Northern University, he was a member of the editorial staff of the Ohio Northern University Law Review. While on the Ohio Northern University Law Review, Mr. Dutton published The Court Vetoes the Legislative Veto: Immigration and Naturalization Service v. Chadha, analyzing a landmark United States Supreme Court decision on bicameralism, the separation of powers doctrine and the Presentment Clause of the United States Constitution. Mr. Dutton was also selected to the Order of Barristers for having exhibited excellence and obtained high honor through the art of courtroom advocacy. Mr. Dutton also served as a justice on the law school’s Moot Court Executive Board, and was the justice in charge of the First Year Appellate Advocacy Program. While in law school, Mr. Dutton also participated in four national moot court competitions, including the Fall National Moot Court Competition, the Phillip C. Jessup International Law Moot Court Competition (Best Written Memorial), and the Benton Privacy Law Competition (Team Coach). Additional achievements by Mr. Dutton while in law school included the authorship and publication of articles on constitutional law which have been published nationally, selection as research assistant to Professor Paul Edwards, and participation on the faculty hiring committee. For Mr. Dutton’s outstanding academic achievement in law school, he was selected to Who’s Who Among American Law Students. Prior to law school, Mr. Dutton’s Bachelor of Arts degree and graduate work was in the field of international relations and international affairs at Florida International University in Miami, Florida where he was born. Prior to attending law school, Mr. Dutton was a firefighter and paramedic with the City of Miami Beach in Miami Beach, Florida. While there Mr. Dutton became one of the first certified paramedics in the State of Florida. He also received a Certificate of Compliance for State Firefighter awarded by the State Fire Marshal’s Office. While serving as a paramedic, Mr. Dutton was also selected to the Special Weapons and Tactics (SWAT) team for the City of Miami Beach Police Department where he received training from the Federal Bureau of Investigation and Army Special Forces in Urban Warfare. Mr. Dutton also received training in fire prevention and enforcement of fire codes and building codes during his education and experience as a firefighter. Professional organizations in which Mr. Dutton is a member include the American Bar Association, Defense Research Institute and the Florida Defense Lawyers Association where he serves as its Continuing Legal Education Chairperson. Mr. Dutton is a charter member of the Medical Claims Defense Network and has served on its board of directors.
