Water Law Prior to practicing law, Randy Wilburn was a consulting engineer, designing utility, land development, environmental, and capital improvement projects in the Austin and Houston areas. While working for the State environmental protection agency, Randy was Director of the Texas water quality protection programs and the Texas water right and water quality assessment programs. Randy was instrumental in the creation of the Rio Grande Alliance, an alliance of U.S. and Mexican environmental and conservation groups focused upon the protection of the environment within the Rio Grande basin. Randy served on the boards of both the Galveston Bay Estuary Program and the Coastal Bend Bays & Estuaries Program. As an attorney, Randy has used his engineering experience to better represent the firm’s clients in environmental, land development, utility, and water issues before various legal venues in Texas. His background in engineering allows Randy to understand complicated technical issues that are often at the center of our clients' legal matters. Randy was the lead counsel before the State Office of Administrative Hearings in the seminal groundwater case, Edwards Aquifer Authority v. James Wilcox focuses his practice on intellectual property litigation and patent prosecution. His experience encompasses numerous trials and a variety of aspects of patent litigation and false advertising litigation in multiple forums, including the district courts, appellate courts, and the Patent Trial and Appeal Board. James has experience with pre-litigation analysis and strategy preparation; drafting of pleadings, motions, and replies; working with experts – from initial identification through expert reports, deposition and pre-trial preparation; analyzing and preparing non-infringement and invalidity contentions; overseeing document production and review; preparing written discovery requests and responses; taking and defending depositions of fact and expert witnesses, including 30(b)(6) designees; and summary judgment briefing. He has handled litigation matters involving a broad spectrum of technologies, including consumer goods, software, pharmaceuticals and polymer additives. As a patent prosecutor, James drafted and prosecuted patent applications in a variety of technological areas, including those involving the consumer goods, electrical, chemical, electromechanical and materials science arts. His technical knowledge in these fields is rooted in his strong physics background developed while obtaining his degree from the Florida State University. While pursuing his juris doctorate, James worked for Human Rights Quarterly, was the president of the Intellectual Property Law Society, the treasurer of the Intellectual Property society and the intellectual property representative to the Student Bar Association. My wife often jokes that I have a one track mind. Once I set my mind to something, there is no going back. She is right. All my life if I truly wanted something I would stop at nothing to get it. (My wife included). Although she says it is annoying sometimes, as my client it is your greatest asset. I am passionate about seeing that you get the best help possible, and I tenaciously represent your best interests. I know that the IRS can be abusive, manipulative and ruthless. They are the most powerful collection agency out there and I’m your best weapon. Let me tell you a little about who I am and how I got here... I grew up in Bountiful, Utah. I graduated from Woods Cross High School in 1997. In 1998 I served as a volunteer service missionary for my church, The Church of Jesus Christ of Latter-Day Saints, for two years. I served in the Netherlands, Amsterdam Mission, where I learned to speak fluent Dutch. Being a missionary basically means service 24 hours a day. It is there that I learned that I wanted to help people for the rest of my life. My wife, Kellye, grew up in Salt Lake City. We met in February 2002 and after a short engagement we were married by October of that same year. I’ve always wanted to be an attorney, but my schooling was stop and go for a long time. We found out we were expecting a baby in December of 2005. When our first son, Tate, was born the doctor laid him in my arms and I knew right then and there that I had to do better for my son. I remember clearly, I had been working at FedEx in their inside sales department at the time. It was a good job, but not great. I knew I needed to do something more. I looked over at my wife and said to her “I need to go back to school. I need to provide for this family.” And thus my motivation was born. I immediately enrolled in school at Weber State University, graduating Cum Laude in 2008, and then attended Ave Maria School of Law where I received my Juris Doctorate in 2012. During all this schooling we welcomed 2 other boys into our family, Hayden in 2008, and Cole in 2011. My family is my motivator. I love them and thank them for always supporting and believing in me. We now live in Layton City, Utah. While attending law school I discovered a passion for tax. It was strange, because many of my colleagues thought I was crazy, but it just made sense to me. I now understand why I enjoyed it so much, because it would become a part of my life in helping others who suffer the heavy hand of collection by the IRS. Upon graduation we moved to Oklahoma where I gained invaluable experience in tax problem representation. After living in Oklahoma for about a year we decided that we wouldn’t be truly happy until we were back in Utah. In the summer of 2013 we came back to Utah and I gained further experience in dealing with the IRS while working with a local firm.
